Overview
These Terms of Service ("Terms") govern your access to and use of the ProfitPeek Shopify application. By installing and using ProfitPeek, you enter into a binding legal agreement with us. We have written these terms to be as transparent as possible, outlining our responsibilities to you, and the limitations of our liability.
1. Service Provision and Usage
ProfitPeek is a financial analytics tool designed to estimate net profit based on the inputs you provide (such as Cost of Goods Sold, shipping profiles) and the data we sync from Shopify and third-party ad networks.
- You agree to use ProfitPeek strictly for lawful business purposes.
- You understand that ProfitPeek requires active API connections to function correctly. If you revoke permissions in Shopify or your Ad Accounts, the service will stop functioning.
2. Data Accuracy & Disclaimer of Liability
This is a critical section regarding the nature of our calculations:
- Estimates, Not Accounting: ProfitPeek is an analytics dashboard, not certified accounting software (like QuickBooks or Xero). The numbers provided are highly accurate estimates designed for day-to-day decision making. They should not be used for official tax filing or government audits.
- No Liability for Losses: Under no circumstances shall ProfitPeek, its founders, or affiliates be held liable for any direct, indirect, incidental, or consequential damages resulting from business decisions you make based on the data provided by our app.
- Data Sync Delays: While we strive for real-time synchronization, API rate limits imposed by Shopify or Ad Networks may cause temporary delays in data reporting. We are not liable for any discrepancies caused by third-party API outages.
3. Subscription, Billing, and Refunds
ProfitPeek operates on a subscription model billed entirely through the official Shopify Billing API.
- Free Trial: We offer a 14-day free trial. If you uninstall the app before the trial expires, you will not be charged.
- Recurring Billing: After the trial, you will be automatically billed on a 30-day cycle directly to your payment method on file with Shopify.
- Refunds: Because billing is managed by Shopify, we do not have direct access to your credit card or the ability to process refunds directly. Refund requests must be handled in accordance with Shopify's standard app refund policies, which typically do not allow for prorated refunds upon mid-cycle uninstallation.
4. Termination of Service
You may terminate this agreement at any time simply by uninstalling ProfitPeek from your Shopify admin panel. We reserve the right to suspend or terminate your access to ProfitPeek immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms (e.g., attempting to reverse-engineer the application, abusing API limits, or using the service for fraudulent activity).
5. Intellectual Property
The Service and its original content (excluding User Data), features, algorithms, and functionality are and will remain the exclusive property of ProfitPeek and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ProfitPeek.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ProfitPeek's parent entity is registered, without regard to its conflict of law provisions.
